Terms of Service

1. Acceptance of terms

By creating an account or using gankapp (the "Service"), you agree to these Terms of Service, the Privacy Policy, the Community Guidelines, and the Wallet & Payments Policy, which together form a single agreement. If you don't agree, you may not use the Service.

Registration requires an active opt-in checkbox, and a confirmation that you are at least 18 years old. gankapp records the date and specific version of the documents you accepted, as evidence of your consent. You can see which version you accepted from the relevant section of your profile.

2. Eligibility and minimum age

You must be at least 18 years old, or the age of legal majority in your country of residence if higher, to create an account. gankapp includes a real-money wallet, live streaming, and direct messaging with no restricted mode for minors, so it is not designed for use by minors.

By registering, you represent that the information you provide (email, username) is accurate and that you meet the age requirement. gankapp may request additional verification and close accounts that don't meet it.

3. Your account

You're responsible for keeping your password confidential and for all activity on your account. Notify us immediately of any unauthorized use.

Each person may keep only one active account, unless gankapp expressly authorizes otherwise (for example, creator or brand accounts). Signing in with Google is also subject to that platform's own terms.

4. Description of the Service

gankapp is a vertical-video and text/image social network, with an algorithmic and chronological feed, search, real-time messaging, live streaming, gamification (ranks, badges, cosmetic shop), and a virtual-currency wallet ("Esmeraldas"/Gems) described in the Wallet & Payments Policy.

The Service is provided "as is" and may change, be suspended, or be discontinued in whole or in part at any time, with or without notice, particularly while the product is in an early development stage.

5. Your content

You keep ownership of the text, images, videos, and other content you post ("User Content"). By posting it, you grant gankapp a worldwide, non-exclusive, transferable, royalty-free license to host, reproduce, distribute, adapt (for example, to transcode video into different formats), and display that content within the Service, solely to operate it, promote it, and comply with the law.

You represent that you hold the necessary rights to what you post and that it doesn't infringe copyright, trademarks, or other third-party rights. gankapp responds to copyright infringement reports through the in-app report system ("copyright" category) and may take down reported content.

6. Prohibited conduct

By using gankapp you agree to follow the Community Guidelines. gankapp may remove content, restrict features, or suspend/close accounts that violate them, at its sole discretion and without prior notice in serious cases.

7. Live streaming

Whoever starts a live stream is responsible for everything that happens during it, including what guests say or what's shown on screen. Streams are recorded automatically and remain available as a replay (VOD) within the Service, subject to the same content and moderation rules as any other post.

gankapp may cut off an ongoing live stream without prior notice if its content violates the Community Guidelines.

8. Suspension and termination

You may delete your account at any time from gankapp.com/delete-account. If you can't sign in, email us at [SUPPORT EMAIL] from the address associated with your account and we will process the deletion manually. gankapp may suspend or close your account, or remove content, if you violate these Terms, the Community Guidelines, or applicable law. Unused Esmeraldas balance is governed by the Wallet & Payments Policy.

9. Limitation of liability

The Service is provided without warranties of any kind, express or implied. To the maximum extent permitted by law, gankapp is not liable for indirect, incidental, or consequential damages arising from use of the Service, including loss of content, loss of Esmeraldas balance for reasons other than a proven gankapp error, or service interruptions.

10. Changes to these Terms

gankapp may update these Terms. If a change is material, we'll notify you within the Service or by email before it takes effect. Continuing to use gankapp after that date means you accept the new terms.

11. Governing law and contact

These Terms are governed by the laws of [COUNTRY / JURISDICTION], without prejudice to any consumer-protection rules of your country of residence that may apply to you on a mandatory basis.

Privacy Policy

1. Data we collect

  • Account data: email, password (stored as a hash, never in plain text), username, display name, and, if you sign in with Google, your Google email and profile.
  • Content: posts, comments, direct messages, live streams (including their recording), and associated metadata (date, hashtags).
  • Wallet data: balance, transaction history (purchases, donations, gifts, post boosts), and Wompi payment reference (we don't store your full card number; Wompi processes that directly).
  • Usage and analytics data: in-app interaction via Microsoft Clarity (session recording and heatmaps, with sensitive fields masked) when this feature is enabled.

Unlike many apps, gankapp does not use your IP address as an identity signal or tie it to your profile for personalization purposes.

2. How we use your data

  • Operating the Service: authenticating you, showing your feed, processing messages and streams, calculating your Esmeraldas balance.
  • Security and fraud prevention, including verifying Wompi payments and automated image/video moderation.
  • User support and responding to reports.
  • Improving the product, including aggregate usage analysis via Microsoft Clarity.
  • Complying with legal obligations.

3. Who we share data with

We don't sell your personal data. We share it only with the providers needed to operate the Service, including:

  • Wompi — processes wallet top-up payments; receives payment data directly, gankapp doesn't store it.
  • Cloudflare — hosts live streams and their recordings.
  • Microsoft Clarity — usage analytics and product-experience insight.
  • Google — if you choose to sign in with your Google account.
  • Automated image/video moderation providers (inappropriate-content detection before or after publishing).
  • Authorities, when required by law.

4. Your rights

You can access, correct, or delete your information from your profile, or by requesting it at [PRIVACY EMAIL]. Depending on your country of residence, you may have additional rights to access, rectify, erase, and port your personal data under applicable data-protection law.

Deleting your account removes your visible profile and content; some records (for example, wallet transaction history) may be retained for as long as required by accounting or tax regulations.

5. Minors

gankapp is not directed at anyone under 18 and does not knowingly collect information from minors. If we discover a minor's account, we will close it and delete the associated data.

6. Security

We use reasonable technical and organizational measures (password hashing, expiring/rotating session tokens, encrypted connections) to protect your data. No system is 100% secure; if an incident affects your data, we will notify you as required by applicable law.

7. Changes to this Policy

We may update this Privacy Policy. Material changes will be announced within the Service before taking effect.

Community Guidelines & Moderation

1. General principles

gankapp aims to be a safe space to create and watch vertical video content. These guidelines apply to posts, comments, direct messages, profile photos, and live streams.

2. Prohibited content and conduct

  • Copyright or other intellectual-property infringement.
  • Nudity or explicit sexual content.
  • Harassment, threats, or incitement to hatred or violence.
  • Impersonating another person or entity.
  • Spam, fraudulent schemes, or artificial manipulation of metrics (including misuse of post Boosts).
  • Any other content that is illegal under applicable law.

These categories map directly to the options available when reporting content in the app.

3. Automated moderation

Uploaded images and videos pass through an automated inappropriate-content detection system before becoming visible to other users. Content flagged by this system may be automatically rejected or held for human review. Text in posts, comments, and messages doesn't currently go through an automated content filter, so it relies mainly on community reports.

4. Reports and human review

Any user can report a post, comment, or profile by choosing a category (copyright, nudity, harassment, impersonation, spam, or other) and an optional description. A human moderator reviews each report and can resolve it by removing the reported content or dismissing the report if no violation is found.

Besides reporting, any user can block another profile; blocking also cuts off messaging between both accounts.

5. Consequences for violating these guidelines

Depending on severity and repetition, gankapp may: remove the specific content, restrict features (for example, posting or live streaming), or suspend or close the account. Serious violations (for example, sexual content involving minors, credible threats of violence) may also be reported to the relevant authorities.

6. Appeals

If you believe your content was removed or your account was limited by mistake, you can write to [SUPPORT EMAIL] with your username and the affected content.

7. Adult content (+18): not allowed

gankapp is NOT an adult-content platform. The following is prohibited anywhere in the Service, including posts, live streams, direct messages, profile fields, and linked external content:

  • Nudity, full or partial, real or illustrated, of identifiable adults.
  • Explicit sexual content (acts, simulated acts, pornographic fetishes, 'NSFW' content in any format, including text, photo, video, audio, sticker, or emoji).
  • Sexual services, escort offers, sexual webcam content, 'OnlyFans'-style offers, or paid access to adult content promoted inside or outside the app.
  • Audio or visual material of a sexual nature whose purpose is to arouse the viewer, distinct from serious educational, medical, or artistic context (which is allowed when necessary to the message, provided it does not otherwise violate these guidelines).

Equally prohibited: hinting at the above in text only. This includes titles, subtitles, hashtags (like '#nsfw', '#xxx', '#18+' and the like), usernames, or profile descriptions that function as a redirect to that kind of material, and calls like 'see the content on my other profile' or links to external sites where it is available.

The automated moderation system filters images and videos at upload time. If such content slips through and is published anyway, community reports ('nudity' category) and human review apply the same policy. Repeat offenses or deliberate circulation of this kind of material through side channels inside the app (DMs, comments, grayscale images, etc.) are treated as a serious violation.

8. Child protection: zero tolerance

Sexual exploitation of minors is a crime, and gankapp treats it with zero tolerance. The following is strictly prohibited anywhere in the Service:

  • Child Sexual Abuse Material (CSAM / 'child pornography'), including AI-generated content that depicts real-looking minors.
  • Grooming: contacting a minor (real, or whose apparent age is under 18) with the intent to sexually exploit them, obtain intimate images of them, or expose them to sexual content.
  • Sextortion of minors: blackmailing a minor to obtain sexual content of themselves or of another minor.
  • Any form of sexualization of minors: minors in suggestive poses, visible underwear, partial or total nudity, or participating in acts of a sexual nature, real, simulated, or drawn/animated (this includes minors depicted as such even when the artistic intent is otherwise legitimate).
  • Promoting, facilitating, or attempting to evade detection with coded language ('young', 'jailbait', 'teen', 'CP', and the like).

If we detect or receive a report of this kind of content:

  • We remove the content immediately and block its redistribution.
  • We suspend or close the involved account, with no possibility of reopening it under the same user or device.
  • We preserve the evidence needed (including account data) for the time required by applicable law to respond to a request from the authorities.
  • We report it to the relevant authorities. In Colombia and most of our countries of operation, this includes the Attorney General's office and NCMEC (National Center for Missing & Exploited Children), IWF (Internet Watch Foundation), or the equivalent body in the country where the conduct occurred. The report is made even if the account was created with false data.

If you find this kind of material inside gankapp, report it using the 'nudity' category and, when possible, also tell us directly at [SUPPORT EMAIL] or through the channels we publish in the app. The report is confidential and does not expose you to retaliation.

9. Harassment and personal conduct

Harassing another person inside gankapp is prohibited. This includes, among other behaviors:

  • Repeated attacks, insults, public humiliation, or mockery of a person or group for their appearance, origin, gender, sexual orientation, religion, disability, ideology, or any other characteristic protected by applicable law.
  • Doxxing: publishing or threatening to publish private personal information (address, phone, workplace, family details) without consent.
  • Threats of physical harm, sexual harassment, unwanted sexual solicitations, or sustained emotional pressure (including adult 'sextortion': blackmail with intimate content to obtain more intimate content, money, or silence).
  • Brigading: coordinating with third parties outside the app (on social media, chats, forums) to launch a concerted attack on a user or content inside gankapp.
  • Cyberstalking: following a person, leaving them repeated messages after they asked you to stop, or systematically monitoring their activity on the app after they have blocked you.
  • Directed 'cancel culture': organizing mass false reports to force the suspension of an account.

Blocking a user is the first line of defense. If the harassment continues from other accounts or channels, escalate to a report ('harassment' category) with whatever evidence you have: screenshots, IDs, dates. Moderation can take additional measures (limiting the harasser's account, suspending it, or reporting to the authorities in serious cases).

Public criticism of public figures, political dissent, or vigorous debate about ideas is NOT, by itself, harassment: gankapp protects expression as long as it stays within the Community Guidelines and respects the same limits as the law.

Wallet, Payments & Virtual Currency Policy (Esmeraldas)

1. What Esmeraldas are

Esmeraldas (Gems) are a virtual currency usable exclusively within gankapp. They are not electronic money, not a cryptocurrency, don't earn interest, and don't represent an investment. Their only use is inside the Service.

2. Buying Esmeraldas

Esmeraldas are bought in fixed-size packages with real money, processed through Wompi as the payment gateway. Prices and package sizes may change without prior notice; the price shown at checkout is the one that applies. gankapp does not store your full card or payment-method details; Wompi processes those directly.

Your balance is credited once Wompi confirms payment. If payment is confirmed but the balance isn't credited due to a proven technical error, contact us at [SUPPORT EMAIL] with your payment receipt.

3. Using Esmeraldas

Within gankapp you can use your Esmeraldas to:

  • Donate to posts, comments, or directly to another user.
  • Send gifts inside a direct-message conversation or during a live stream.
  • Boost ("Ad") your own post so it appears more often in the "for you" feed during a time window.
  • Buy cosmetic profile items (frames, icons, titles) in the shop.

4. Final sale, no refunds

All Esmeraldas purchases are final. gankapp does not offer refunds except where: (a) consumer-protection law in your country requires it, or (b) there is a proven gankapp technical error (for example, a duplicate charge or a balance not credited after a confirmed payment). Esmeraldas already spent within the Service (donations, gifts, boosts, shop purchases) are not refundable under any circumstance, since they transfer or are consumed immediately.

5. Conversion to earnings and creator payouts

Esmeraldas are a virtual currency for in-app use. By default they are NOT money, NOT redeemable, and NOT withdrawable. However, users with an enabled creator account can accumulate Esmeraldas and convert them into an earnings balance (in USD) that is eligible for withdrawal, subject to the rules in this section.

  • Conversion minimum: a convertable balance becomes available once the user has accumulated at least the threshold that gankapp publishes in the app.
  • Hold period: once conversion is requested, the balance is held for a grace period before it can be withdrawn. This is to cover chargebacks and reasonable disputes.
  • Minimum payout: USD 25 (or its COP equivalent at the exchange rate at the time of payment).
  • Payment providers: Wompi (local transfer to a bank account in Colombia, in COP) and, where available, Wise or PayPal (international, in USD). gankapp may add or remove providers without prior notice.
  • Frequency: each creator may have only one payout request in flight at a time. Additional requests unlock when the previous one is marked paid, rejected, or cancelled.
  • Identity verification: to process a payout, gankapp may require identity verification (KYC) of the recipient account holder. Withdrawals to third-party accounts are not allowed.
  • Tax responsibility: the creator is responsible for any applicable taxes on the income received. gankapp may request tax information and, where required by law, report payments to the relevant authorities.

Receiving Esmeraldas from another user (for example, as a donation or gift) does NOT by itself create a withdrawal right: only the balance that has been converted to earnings through the official flow is withdrawable.

gankapp keeps a record of the total amount withdrawn by each creator (lifetime_withdrawn_usd_cents) for accounting and fraud-prevention purposes. This record is visible in the earnings section and is retained for as long as required by applicable law.

Accounts suspended or closed for breach of the Terms, the Community Guidelines, or applicable law forfeit any unwithdrawn convertible balance. Requests in flight at the time of closure may be rejected and the associated funds are non-refundable.

6. Account closure and balance

If your account is closed for violating these Terms or the Community Guidelines, you lose any unused Esmeraldas balance, with no right to a refund. If you delete your account voluntarily, we recommend using your balance first.

7. Taxes

Any tax applicable to your purchase (for example, VAT) is calculated and charged based on the location information Wompi has for you at checkout. You're responsible for any personal tax obligations arising from your use of the Service.

Empleo — Conditions for Job Seekers and Companies, KYC, API, and GDPR Rights

1. Definitions and scope

A "job seeker" is a user with a professional profile created in the Empleo section. A "Company" is a legal entity registered in Empleo by one or more users (members). An "Offer" is a job posting published by a Company. An "Application" is a job seeker's response to an Offer. "KYC" is the verification process for a Company's legal identity. The "API" is the programmatic interface exposed at https://api.gankapp.com/jobs/* for verified Companies.

Empleo is operated by [LEGAL ENTITY NAME] under gankapp's general terms, with the addition of Company KYC and compliance with applicable international regulation (GDPR in the EU, Habeas Data in Colombia, EU Pay Transparency Directive 2023/970 for EU offers, EU AI Act for any automated decision-making).

2. Personal data collected (GDPR Art. 5(1)(c))

  • Job seeker: professional headline, summary, skills (normalised), years of experience, current role, current company, education level, search preferences (role, country, city, salary, work mode), languages, CV URL, open-to-work status, visibility level, and accepted terms version.
  • Company: legal name, trade name, country of legal seat, tax identification number (NIT, EIN, RFC, VAT or other per country), website, domain (derived), industry, size, founding year, logo, and members.
  • KYC: uploaded tax document (R2 encrypted at rest with SSE-S3), domain verification token (256 bits, one-time), verification date, reviewer admin id, and review notes.
  • Application: cover letter, CV (immutable snapshot at apply time), expected salary, and timestamps for each state transition.
  • API: API key with SHA-256 hash, public prefix, scopes, last used, subscribed webhook events, and delivery log.

Work data is stored in a table separate from the social profile (job_seeker_profiles) precisely to minimise mixing of the two domains and to facilitate GDPR Art. 5(1)(c) (minimisation) and Art. 20 (portability).

4. Company verification (KYC)

  • To publish Offers, a Company must complete KYC. Initial status is `pending`.
  • KYC requires (a) uploading a valid tax document for the country (NIT, EIN, RFC, VAT or other) and (b) demonstrating control of the website domain by uploading a file to `https://{domain}/.well-known/gankapp-verify-{token}` or adding a TXT record with the token in DNS.
  • An administrator reviews the submission within 24-48 business hours. On approval, status becomes `verified`; on rejection, `rejected` with a reason. The Company can re-submit a new request if rejected.
  • KYC expires every 365 days. The Company receives a reminder 30 days before expiry to re-verify. On expiry, active offers are auto-paused.
  • gankapp does NOT verify the identity of the Company's legal representative in v1. The "Verified by GANGAPP" seal indicates only that the Company demonstrated domain control and provided a valid tax document. The Company remains responsible for the accuracy of the information provided.
  • KYC documents are stored encrypted at rest (SSE-S3). Only authorised administrators can view them, in the context of the specific submission's review.

5. Offer publication and salary transparency

A verified Company can publish Offers. Each Offer has a country, optional city, work mode (remote / hybrid / onsite), contract type, experience level, description, required skills, and optional salary range and application deadline.

For offers whose country is in the European Union (EU 27), the salary range (min, max, currency, period) is MANDATORY under EU Pay Transparency Directive 2023/970. Offers without a complete salary range in the EU cannot be published.

gankapp is not a party to the employment relationship between the job seeker and the Company. Salary payments occur outside the platform. gankapp does not process or hold funds related to hiring.

Offers auto-expire 60 days after publication. The Company can re-publish the offer or create a new one. Data on expired offers is retained in the database for audit but is not visible to job seekers.

6. Applications and data shared with Companies

When applying to an Offer, the job seeker shares with the Company: profile name, headline, summary, skills, CV (immutable snapshot), cover letter, and expected salary (if provided).

This data is shared ONLY with the Company that owns the Offer. It is NOT shared with other Companies, used for advertising, or disclosed to third parties.

Job seekers can withdraw their application at any time from /empleo/me/postulaciones. The Company will see the status change, but the application data is retained for the Company's audit until the Offer expires.

7. Public API for verified Companies

Verified Companies can issue API keys from /empleo/empresa/:id/api-keys. The API exposes offer CRUD endpoints, application reading and state transitions, webhook management, and the Company profile read. The OpenAPI 3.1 spec is publicly available at https://api.gankapp.com/jobs/docs.

  • API key format: `gjp_live_<32 bytes hex>` for production, `gjp_test_<32 bytes hex>` for sandbox. The full secret is shown ONCE at creation; afterwards, only the prefix and SHA-256 hash are stored in the database.
  • Each key has a list of scopes (permissions). Revocation is immediate. Revoked keys CANNOT be reactivated.
  • Rate limit per API key: 600 req/min for `live`, 60 req/min for `test`. The API returns 429 with `Retry-After` when exceeded.
  • Webhooks are signed with HMAC-SHA256. Header `X-Gankapp-Signature: sha256=<hex>`, `X-Gankapp-Timestamp: <unix>`, `X-Gankapp-Delivery: <uuid>`. Verify with the secret delivered at webhook creation. Reject if `|now - timestamp| > 5min` (anti-replay).
  • Retry policy: 1m, 5m, 30m, 2h, 12h, 24h. After 6 attempts, the webhook status becomes `failed` and the owner is notified.

8. GDPR / Habeas Data rights for job seekers

Job seekers have the following rights over their personal data in the Empleo section:

  • Access (Art. 15): see what data we hold and how it is processed. Visible at /empleo/me.
  • Rectification (Art. 16): correct inaccurate data. Edit profile at /empleo/me/perfil.
  • Erasure (Art. 17): delete the account and data. POST /jobs/me/account-data/delete. 30-day grace period before final deletion; revocable during that period.
  • Portability (Art. 20): export all data in structured JSON format. GET /jobs/me/data-export.
  • Object (Art. 21): object to processing. Email [PRIVACY EMAIL].
  • Not be subject to automated decisions (Art. 22): request human review of any decision. Email [PRIVACY EMAIL].
  • Complaint to supervisory authority: EDPB coordinates European authorities (https://edpb.europa.eu/about-edpb/about-edpb/members_en). In Colombia: SIC. In Spain: AEPD. In France: CNIL.

9. Prohibited content and anti-discrimination

gankapp applies automatic detection of exclusionary language (gender, age, ethnicity, religion, disability, sexual orientation, family status, nationality, appearance) in Offers. Detection is a soft-warn: the Offer can be published, but it is flagged for manual review and the moderation team is notified.

It is prohibited to publish Offers with illegitimate exclusionary requirements under applicable law (Directive 2000/78/EC in the EU, Title VII of the Civil Rights Act in the US, and equivalent rules in other jurisdictions). gankapp cooperates with regulatory authorities and may remove Offers and suspend Companies that violate these rules.

The Company is the final party responsible for the content of its Offers. gankapp is a technical intermediary and applies the community rules and moderation obligations that the law assigns to it.
